Belluck Law wins motion in a mesothelioma case involving exposure to a clay product with asbestos-containing talc

Last week, the firm of Belluck Law won a motion in a mesothelioma case involving exposure to a clay product made with asbestos-containing talc. The defendants petitioned the court to dismiss the case on summary judgment, but the court denied the request. The case will proceed to trial. Read the decision.

Clay products and asbestos

Certain clay products that used talc as an ingredient may have contained asbestos. Often mineral deposits of talc and asbestos intersected so mining talc meant that asbestos was mined along with it. Those who worked with and/or around such clay products were exposed to asbestos and are at risk for mesothelioma and other cancers.

Clay products containing asbestos are particularly dangerous because techniques used to manipulate these materials include sanding and scraping, which cause them to become pulverized, airborne, and easily inhaled.

Just like other asbestos exposures, the dust from clay on clothes can cause secondary exposures in family members and others even if they didn’t work or play directly around those materials.

Talcum powder and asbestos

Talc mined in areas where asbestos deposits intersect talc deposits contained asbestos, and consequently, products that used it as an ingredient also contained asbestos. When used in powder form, talc is easily inhaled exposing users and those around them to asbestos. Products using talc that are known to have contained asbestos include certain baby powders, various cosmetics and makeup, clay, and certain toy kits for kids.

Asbestos, mesothelioma, lung cancer, ovarian cancer and other cancers

Asbestos is a dangerous carcinogen exposure to which can cause development of mesothelioma, lung cancer, ovarian cancer or other cancers. Mesothelioma, in particular, can affect different organs. Pleural mesothelioma grows on the lining of the lung and presents with respiratory symptoms among others. Peritoneal mesothelioma, however, presents predominantly with gastrointestinal symptoms. These symptoms often present in a very generic form and worsen over time. Mesothelioma is extremely aggressive and requires a center of excellence for treatment. A diagnosis of mesothelioma is official when a biopsy has confirmed the presence of mesothelioma cells in the tissue sample. Mesothelioma cannot be diagnosed with imaging alone. Knowledge of past asbestos exposures combined with symptoms mentioned above should be cause of concern and should prompt medical testing.
